DISTANCE SALES CONTRACT
All users are deemed to have read and accepted this Distance Sales Contract upon completing their order on giftdeliveryturkey.com.
This is a Distance Sales Contract established between:
FLOWER ART INTERNATIONAL FZE (hereinafter referred to as the “SELLER”)

The Customer (hereinafter referred to as the “BUYER”).
ARTICLE 1 – SUBJECT
The subject of this Agreement is to determine the rights and obligations of the parties regarding the sale and delivery of the product/service ordered electronically by the BUYER through giftdeliveryturkey.com, including its specifications and sales price as indicated at the time of purchase.
This Agreement is prepared in accordance with applicable consumer protection and distance sales regulations.
ARTICLE 2 – ESTABLISHMENT OF THE CONTRACT
2.1 The BUYER declares that he/she has read, understood, and accepted all provisions of this Agreement.
2.2 The BUYER confirms that he/she has been fully informed about the essential characteristics of the product/service, total price including taxes, payment method, delivery conditions, and right of withdrawal before completing the order.
2.3 The BUYER acknowledges that the terms of this Agreement do not contain unfair conditions and are prepared in accordance with the principles of good faith and commercial fairness.
2.4 This Agreement becomes effective upon electronic approval by the BUYER and successful completion of payment.

ARTICLE 5 – PRODUCT INFORMATION
The type, quantity, brand/model, color, price, payment method, and delivery details of the product/service subject to this contract are specified on the product page and invoice.

Sales Price: As displayed at checkout (including applicable taxes)
Payment Method: As selected at checkout
Delivery Date: As selected by the BUYER
ARTICLE 6 – GENERAL PROVISIONS
6.1 The BUYER declares that he/she has reviewed and electronically approved all preliminary information regarding the product/service.
6.2 The product shall be delivered to the address specified by the BUYER within the legal period not exceeding 30 days.
6.3 If delivery is to a third party designated by the BUYER, the SELLER shall not be held responsible if such person refuses to accept delivery.
6.4 The SELLER is responsible for delivering the product in sound condition and in compliance with the order specifications.
6.5 Electronic confirmation of this Agreement and full payment are mandatory for delivery. If payment is not completed or is canceled in bank records, the SELLER is released from delivery obligation.
6.6 In cases of force majeure (including but not limited to adverse weather conditions, traffic disruptions, supply shortages, or operational issues), the SELLER shall inform the BUYER. The BUYER may request cancellation, replacement (if available), or postponement.
6.7 When delivery time slots of 09:00–15:00 or 15:00–21:00 are selected, the BUYER acknowledges that delays may occur due to traffic density and operational demand, and accepts reasonable timing variations.
6.8 If the BUYER cancels the order before preparation or dispatch, the paid amount shall be refunded within 10 days.
6.9 If the BUYER fails to fulfill payment obligations, the SELLER reserves the right to initiate legal proceedings for collection of the unpaid amount, including applicable interest and legal expenses.
DELIVERY RESTRICTIONS AND SELLER’S RIGHT TO CANCEL
Due to operational limitations, flower delivery is not available to the following regions:
Silivri, Şile, Çatalca, Arnavutköy, and certain neighborhoods of Sarıyer district.
Orders placed for these areas will be canceled and refunded within 10 days.
The SELLER also reserves the right to cancel any order for legitimate reasons including but not limited to:

Inability to supply the product

Impossibility of delivery

Incomplete or inconsistent order information

Payment failure
In such cases, payments received shall be refunded within 10 days.
ARTICLE 7 – RIGHT OF WITHDRAWAL
In accordance with applicable consumer protection regulations, the right of withdrawal does not apply to:

Perishable goods (flowers, cakes, chocolates, etc.)
-
Customized or personalized products
-
Goods prepared specifically upon the BUYER’s request
-
Products that are not suitable for return due to their nature
Therefore, once preparation of the floral arrangement has begun, cancellation or withdrawal may not be possible.
ARTICLE 8 – GOVERNING LAW AND JURISDICTION
This Agreement shall be governed by the laws of the United Arab Emirates.
Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the courts of Ajman, United Arab Emirates.
